Florida Sues Discord Over Who It Lets In
The state's complaint recasts weak age screening and thin content moderation as deceptive trade practices and a public nuisance.

Florida Attorney General James Uthmeier sued Discord in Glades County in mid-October 2026, alleging the messaging platform misrepresented its safety practices and failed to keep minors out. The suit seeks injunctive relief requiring stricter controls plus restitution the state says could reach millions.
The complaint pleads violations of the Florida Deceptive and Unfair Trade Practices Act and the state's Online Protection Law, along with negligence, negligent misrepresentation, and public nuisance. The theory is not that Discord hosts unlawful content but that it told parents safety was central to the product while leaving age screening and content monitoring too weak to make that claim true.
The public-nuisance count is the part worth watching. Age-verification mandates have so far been fought as First Amendment cases about whether a state may condition access to speech on proving identity. A nuisance and consumer-protection theory sidesteps that framing: it treats the absence of age checks as a business practice rather than a speech regulation, which changes the standard a court applies and the remedy available.
Discord disputed the characterization, with a spokesperson saying it does not reflect the platform the company built or its investments in user safety. The company has not yet filed a response.
Florida's own age-verification statutes are already in litigation on constitutional grounds, and the Eleventh Circuit recently cleared the way for the state to enforce its social media limits for minors while that challenge proceeds. This suit opens a second front using ordinary state consumer law, and if it survives dismissal it gives other attorneys general a route that does not require winning a First Amendment argument first.

Discord told parents that safety is at the core of everything they do. That was false.
